Terra Golfia designs, organises and markets premium golf, wine and cultural journeys in South Africa, Europe and international destinations.
Purpose of the Contract
These General Terms and Conditions of Sale govern the contractual relationship between Terra Golfia and any client booking a trip via the website www.terragolfia.com, by email or through an authorised representative.
They define the rights and obligations of both parties and constitute the sole contractual framework applicable to any confirmed booking.
Booking and Registration
A booking becomes effective when:
The registration form or contract has been signed, and
The deposit has been received in Terra Golfia’s bank account.
Any registration implies full acceptance of these Terms and Conditions and of the specific conditions stated in the brochure or programme of the selected trip.
Payment Terms

Deposit: 30 percent of the total trip amount, non refundable.
Balance: payable 90 days before departure. -
Payments must be made exclusively by bank transfer in euros EUR or South African rands ZAR, according to the invoice instructions.
Cash payments are not accepted. -
If a local service provider hotel, lodge, golf club, transport company requires a non refundable deposit prior to departure, this amount will be added to the client’s deposit and clearly stated on the invoice.
Pricing
Prices are expressed in euros EUR or South African rands ZAR depending on the trip.
They include all services mentioned in the programme, except:
international flights
drinks, tips and personal expenses
any service not expressly listed as included
Price adjustments may occur in case of:
significant currency fluctuations
changes in local taxes
unpredictable increases in service costs fuel, transport, etc.
Any variation exceeding plus or minus 3 percent will be notified to the client before departure.
Cancellation by the Client
Any cancellation must be notified in writing to Terra Golfia dated email being valid.
Cancellation fees apply as follows:
More than 90 days before departure: 30 percent of the total amount
Between 90 and 60 days before departure: 50 percent
Less than 60 days before departure: 100 percent of the total amount
Amounts already paid to third party providers hotels, lodges, golf clubs, transport companies are non refundable if they cannot be recovered.
Terra Golfia may, at its discretion, offer a credit note or postponement valid for 12 months depending on the situation.
Modification or Cancellation by Terra Golfia
Terra Golfia reserves the right to modify a programme if external circumstances require it force majeure, provider unavailability, insufficient group size.
In such cases, the client may choose between:
a postponement
an equivalent trip
or a refund of amounts paid excluding non recoverable fees
No additional compensation may be claimed.
Liability
Terra Golfia acts as organiser and coordinator but uses independent providers for accommodation, food, transport and activities.
It cannot be held responsible for damage, delays, loss, accidents, illness or incidents attributable to:
a third party unrelated to the trip
a fault or negligence by the client
a force majeure event weather conditions, strikes, conflicts, pandemics, border closures
The maximum financial liability of Terra Golfia cannot exceed the total price of the trip booked.
Although not subject to European law, Terra Golfia voluntarily adheres to the principles of EU Directive 2015 2302 on package travel, without submission to EU jurisdiction.
Health and Physical Conditions
The client is responsible for ensuring they are medically fit to travel and participate in the planned activities.
Any medical condition must be communicated prior to booking.
Personal Effects and Equipment
Luggage, golf clubs and personal belongings remain under the sole responsibility of the client throughout the trip.
Terra Golfia declines liability in case of theft, loss or damage including in vehicles or hotels.
Travel insurance covering baggage is strongly recommended.
Travel Insurance
No insurance is included in our prices.
Each traveller must purchase comprehensive travel insurance covering at minimum:
cancellation or interruption
medical assistance and repatriation
loss or theft of luggage
personal liability abroad
Terra Golfia cannot be held responsible for the absence of adequate insurance.
Financial Protection and Insolvency
M2G Holding PTY Ltd, registered in South Africa, is not subject to the European financial guarantee requirement for repatriation.
However, Terra Golfia undertakes to:
maintain client deposits in a dedicated bank account until full service confirmation
refund in full any trip not delivered in case of internal insolvency before departure
When trips are sold by a European or Canadian tour operator, that operator acts as the principal organiser and provides financial protection and repatriation in compliance with EU Directive 2015 2302.
In such cases, Terra Golfia acts solely as the local DMC Destination Management Company.
Claims and Disputes
Any claim must be submitted in writing within 7 days after the end of the trip, with supporting documents.
In the event of unresolved disputes, the parties agree to private arbitration through the Arbitration Foundation of Southern Africa AFSA under South African law.

Personal Data
Data collected for a booking is used solely for trip management and legal compliance.
Compliance: POPIA South Africa and GDPR European Union.
No data is transferred to third parties without operational necessity.

Applicable Law and Jurisdiction
This contract is governed by South African law.
In case of dispute, the courts of Cape Town South Africa have exclusive jurisdiction.
All proceedings will be conducted in English.
Contract Language
These General Terms and Conditions are available in French and English.
In case of discrepancy, the English version prevails.
